Direct service self-catering gîtes
Article 1– This seasonal rental contract is reserved exclusively for the rental of Self-catering Gîtes de France approved by the Relevant Departmental Office on behalf of the National Federation of Gîtes de France. The National Federation of Gîtes de France is not liable for use by third parties or for purposes other than tourism.
Article 2 – Length of the stay: The tenant signing this contract for a specific length of time cannot in any way exercise a right to remain in the accommodation at the end of the stay.
Article 3 – Conclusion of contract: Booking becomes effective when the tenant has sent the owner a deposit for 25% of the total amount of the rental and a signed copy of the contract before the date on the front page of the contract. A second copy of the contract must be kept by the tenant.
The rental concluded between the two parties can in no case be used by other persons without the owner’s written approval. Breach of this article may lead to the immediate termination of the rental and the total amount of the rental will be due the owner.
Article 4 – Cancellation by tenant: All cancellations must be notified by registered letter or telegram to the owner.
a) Cancellation before arrival:
The deposit is not refundable. The owner may ask for payment of the total amount, if the cancellation is made less than 30 days before the date of entry into the accommodation.
If the tenant does not show up within 24 hours of the date of arrival on the contract, this contract is null and void and the owner is free to dispose of his gîte. The deposit is not refundable and the total amount of the rental will be due the owner.
b) In case of a shortened stay: The amount of the rental remains due to the owner, and there will be no refund for the tenant.
Article 5 – Cancellation by the owner: The owner returns the total amount paid by the tenant plus a compensation which is at least equal to what the tenant would have paid if he/shehad cancelled on this date.
Article 6 – Arrival: The tenant must arrive on the day and at the time written on the contract. In case of late or delayed arrival, the tenant must warn the owner.
Article 7 – Payment: The balance of the price of the rental is paid on arrival in the gîte.
Article 8 – Inventory: An inventory is carried out and signed both by the tenant and the owner or a representative on entering and leaving the gîte. This inventory is the only reference in the case of claims as to the state of the gîte. The cleanliness of the gîte when the tenant enters will appear on the inventory. The tenant is responsible for cleaning the gîte during his stay and before leaving. The cleaning fee (if available) is shown on the details page of the gîte.
Article 9 – Guarantee deposit: When the tenant arrives, a guarantee deposit (amount stipulated in the contract) is requested by the owner. After the final inventory, just before leaving, this deposit is fully refunded except in the case of damage. In the case of a shortened stay rendering an inventory impossible, the guarantee deposit will be returned to the tenant within a week.
Article 10 – Use of the accommodation: The tenant must ensure the peaceful nature of the accommodation and use it for its established purpose.
Article 11 – Capacity: This contract is drawn up for a maximum number of people. If the number of tenants exceeds the capacity, the owner has the right to refuse the extra persons. The tenant will be considered liable for any modification or breach of contract.
Article 12 – Pets: This contract stipulates whether the tenant is allowed or not to bring pets. If the tenant does not respect this clause, the owner can deny access to the gîte. In this case, no refund will be made.
Article 13 – Insurance: The tenant is responsible for all the damages of his doing. He must have an insurance policy to cover these different risks.
Article 14 – Payment of charges : At the end of the stay, the tenant must pay the charges not included in the price. The amount is calculated on the basis mentioned in this contract and in the description page, and a receipt is given by the owner.
Article 15 – Claims: Any complaint related to the inventory or differences between the description and the actual rental, must be lodged with the Departmental Office of the Gîtes de France within 3 days of the start of the contract. Any other claims must also be adressed to the Office as soon as possible by letter. In the case of continuing disagreement, claims can be lodged with the Quality Service of the National Federation of the Gîtes de France which will do everything in its power to reach a mutual agreement.
